Deferring Your Course While On A Student Visa Information From migration Agency In Sydney

It can be difficult for international students to manage their studies when unforeseen and difficult circumstances arise. Some students decide to defer their course (leave of absence or taking a break) to avoid subject failure, unsatisfactory results or student visa cancellation. For around 6 -12 months students can defer their studies, but it is important to be wary on how long a course can be deferred as some providers may have restrictions.

You may have the option to defer your offer Depending on your course for up to one year. This means in your course we’ll hold a place for you to enroll in following semester or year. How to defer your course:

For the overseas student registered providers must assess the deferral of commencement of study or suspension of study according to the National Code for assessing and approving changes to enrolment in accordance with registered provider’s documented procedures. 

You will first have to apply and be accepted by an institution, if you want to defer a university offer in Australia. The process of deferral is quite simple: either directly through the university’s own online portal or if you’re a domestic student you can submit a deferral request through state or territory’s Tertiary Admissions Centre. Work rights during course deferral period:

The Student Visa has the condition 8105: when the holder’s course of study or training is in session’, the holder must not engage in work in Australia for more than 40 hours a fortnight during any fortnight. In Australia lawful non-citizens have full work rights unless their visa has a condition saying otherwise. Therefore, you will have full work rights if your course is not in session.

Condition 8105:

1A) before the holder’s course of study commences the holder must not engage in any work in Australia.

1A) Subject to sub clause 2) when the holder’s course of study or training is in session the holder must not engage in work in Australia during any fortnight for more than 40 hours a fortnight.

2)  Sub clause (1) does not apply:

a) When the course particulars were entered in the Commonwealth Register of Institutions to work that was specified as a requirement of the course and Courses for Overseas Students. 

b) If the holder has commenced the masters degree by research or doctoral degree, in relation to a student visa granted in relation to a master’s degree by research or doctoral degree.

3) In this clause:

Fortnight means the period of fourteen days commencing on a Monday.

Criteria for course deferral:

According to the National Code, if it believes there are compassionate or compelling circumstances a registered provider may defer or suspend the enrolment of a student. To support their claims students are required to provide evidence.

Education providers have their own policies in which they will allow course deferment that may specify circumstances, however this varies by institution.

A provider may allow studying an international student to put a deferral in place or at a reduced load. An extension of the Certificate of Enrolment would require for compelling reason or compassionate, i.e. the students’ course progress or wellbeing affected by circumstances beyond the control of the student. There is no restriction on hours of work permitted and course is considered “out-of-session” if students are permitted to defer their course of study. During the period of the deferral dependants are permitted to remain in Australia. The Department has found that a student has deferred for non-genuine reasons can consider visa cancellation and on a Student visa remains in Australia for purposes not consistent with their visa. 

If, put a deferral in place a student can still retain their student visa status under Standard 9 of the National Code or a provider allows an international student to study at a reduced load.  This avenue could reduce the financial cost of tuition fees per semester as Work restrictions still apply. 

Defining ‘in session’ and “out of session”

In session course

•    the points will be credited towards their main course if a student is undertaking another course during a break from their main course

•    (including periods when exams are being held) for the duration of the advertised semesters;

Out of Session course

•    for Providers of Education and Training to Overseas Students if the course has been deferred or suspended in line with Standard 9 of the National Code of Practice

•    during scheduled course breaks

•    due to the default of their education provider if a student’s enrolment has been cancelled, , until they secure commence the course and alternative enrolment

•    alternative enrolment if a student has completed their course as scheduled and still holds a valid Student visa
